Definitions​

  • “Husarnet Company” - Husarnet sp. z o.o.
  • “Husarnet” - product of Husarnet sp. z o.o.
  • “You” - yourself and any entities you represent.
  • “Website” - all content and services available at or through the websites in the domain husarnet.com, including, but not limited to Husarnet web app ( app.husarnet.com), Husarnet Support Forums, Husarnet hosting services and Husarnets microservices available at Husarnet marketplace
  • “Platform” - the Husarnet platform, including, but not limited to services available under app.husarnet.com domain Husarnet marketplace - a part of app.husarnet.com where You can buy Microservices
  • Microservice - additional services available for purchase at Husarnet marketplace
  • Husarnet Client - a Husarnet software running on devices connected by Husarnet Pricing Plan - a price table including fees for Husarnet services
  • “Hosting” - the Husarnet hosting service.
  • “Source code” - the preferred form of the work for making modifications to it
  • “Object code” - any non-source form of a work.

Introduction​

The following terms and conditions govern all use of Husarnet website and all content, and services available at or through the Website.

The Website is owned and operated by Husarnet Company. The Website is offered subject to your acceptance without modification of all of the terms and conditions contained herein and all other operating rules, policies (including, without limitation, Husarnets’s Privacy Policy and Community Guidelines) and procedures that may be published from time to time on this Site by Husarnet Company(collectively, the “Agreement”).

Please read this Agreement carefully before accessing or using the Website. By accessing or using any part of the web site, you agree to become bound by the terms and conditions of this agreement. If you do not agree to all the terms and conditions of this agreement, then you may not access the Website or use any services. If these terms and conditions are considered an offer by Husarnet Company, acceptance is expressly limited to these terms. By agreeing to this Agreement, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

Your Husarnet Account​

If you create an account on the Website, you are responsible for maintaining the security of your account and you are fully responsible for all activities that occur under the account. You must immediately notify Husarnet Company of any unauthorized uses of your account or any other breaches of security. Husarnet Company will not be liable for any acts or omissions by you, including any damages of any kind incurred as a result of such acts or omissions.

Responsibility of Contributors​

If you post material to the Website, post links on the Website, or otherwise make (or allow any third party to make) material available by means of the Website (any such material, “Content”), You are entirely responsible for the content of, and any harm resulting from, that Content. That is the case regardless of whether the Content in question constitutes text, graphics, an audio file, or computer software. By making Content available, you represent and warrant that:

  • the downloading, copying and use of the Content will not infringe the proprietary rights, including but not limited to the copyright, patent, trademark or trade secret rights, of any third party;
  • if your employer has rights to intellectual property you create, you have either (i) received permission from your employer to post or make available the Content, including but not limited to any software, or (ii) secured from your employer a waiver as to all rights in or to the Content;
  • you have fully complied with any third-party licenses relating to the Content, and have done all things necessary to successfully pass through to end users any required terms;
  • the Content does not contain or install any viruses, worms, malware, Trojan horses or other harmful or destructive content;
  • the Content is not spam, and does not contain unethical or unwanted commercial content designed to drive traffic to third party sites or boost the search engine rankings of third party sites, or to further unlawful acts (such as phishing) or mislead recipients as to the source of the material (such as spoofing);
  • the Content is not pornographic, does not contain threats or incite violence, and does not violate the privacy or publicity rights of any third party;
  • your content is not getting advertised via unwanted electronic messages such as spam links on newsgroups, email lists, blogs and websites, and similar unsolicited promotional methods;
  • your content is not named in a manner that misleads your readers into thinking that you are another person or company; and
  • you have, in the case of Content that includes computer code, accurately categorized and/or described the type, nature, uses and effects of the materials, whether requested to do so by Husarnet Companyor otherwise.

Forum User Content License​

User contributions on Forums are licensed under a Creative Commons Attribution-NonCommercial-ShareAlike 3.0 Unported License. Without limiting any of those representations or warranties, Husarnet Company has the right (though not the obligation) to, in Husarnet Company’s sole discretion (i) refuse or remove any content that, in Husarnet Company’s reasonable opinion, violates any Husarnet policy or is in any way harmful or objectionable, or (ii) terminate or deny access to and use of the Website to any individual or entity for any reason, in Husarnet Company’s’s sole discretion.

Husarnet User Content License​

The whole content uploaded to the Platform by the user becomes his sole property. Husarnet Companywill not use or distribute these resources in any purpose other than those required for the provision of Husarnet services. Removed content may remain in backup copies for a reasonable period of time. Husarnet Company makes every effort to keep user data associated with Husarnet services safe and secured against access by third parties, with the exception of legally binding court judgment or government organizations entitled to require such access.

Payment and Renewal​

General Terms​

Optional paid services or upgrades may be available on the Website. When utilizing an optional paid service or upgrade, you agree to pay Husarnet Company the monthly or annual subscription fees as indicated. Payments will be charged on a pre-pay basis on the day you begin utilizing the service or upgrade and will cover the use of that service or upgrade for a monthly or annual subscription period as indicated. For additional Microservices from Husarnet Marketplace Husarnet Company will charge a monthly fee based on the usage. Per-minute price for each Microservice may vary. All fees and charges are non refundable.

Automatic Renewal​

Unless you notify Husarnet Company before the end of the applicable subscription period that you want to cancel a service or upgrade, your subscription will automatically renew and you authorize us to collect the then-applicable annual or monthly subscription fee (as well as any taxes) using any credit card or other payment mechanism we have on record for you. Subscriptions can be canceled at any time.

Please refer to our pricing section at https://husarnet.com for a description of the fees payable in connection with the Service.

Third Party Payment Processing​

We use a third party payment processor to process payments made to Husarnet Company. In connection with the processing of such payments, we do not retain any personally identifiable information or any financial information such as credit card numbers. Rather, all such information is provided directly to our third party processor https://stripe.com/ , whose use of your personal information is governed by their privacy policy, which may be viewed at https://stripe.com/en-pl/privacy .

Services​

Hosting, Support Services Optional Hosting and Support services may be provided by Husarnet Company under the terms and conditions for each such service. By signing up for a Hosting/Support or Support services account, you agree to abide by such terms and conditions.

Responsibility of Website Visitors​

Husarnet Company has not reviewed, and cannot review, all of the material, including computer software, posted to the Website, and cannot therefore be responsible for that material’s content, use or effects. By operating the Website, Husarnet Company does not represent or imply that it endorses the material there posted, or that it believes such material to be accurate, useful or non-harmful. You are responsible for taking precautions as necessary to protect yourself and your computer systems from viruses, worms, Trojan horses, and other harmful or destructive content. The Website may contain content that is offensive, indecent, or otherwise objectionable, as well as content containing technical inaccuracies, typographical mistakes, and other errors. The Website may also contain material that violates the privacy or publicity rights, or infringes the intellectual property and other proprietary rights, of third parties, or the downloading, copying or use of which is subject to additional terms and conditions, stated or unstated. Husarnet Company disclaims any responsibility for any harm resulting from the use by visitors of the Website, or from any downloading by those visitors of content there posted.

Content Posted on Other Websites​

We have not reviewed, and cannot review, all of the material, including computer software, made available through the websites and webpages to which Husarnet Company website links, and that link to Husarnet website. Husarnet Company does not have any control over those non-Husarnet websites and webpages, and is not responsible for their contents or their use. By linking to a non-Husarnet website or webpage, Husarnet Company does not represent or imply that it endorses such website or webpage. You are responsible for taking precautions as necessary to protect yourself and your computer systems from viruses, worms, Trojan horses, and other harmful or destructive content. Husarnet Company disclaims any responsibility for any harm resulting from your use of non-Husarnet websites and webpages.

As Husarnet Company asks others to respect its intellectual property rights, it respects the intellectual property rights of others. If you believe that material located on or linked to by Husarnet Company websites violates your copyright, and if this website resides in the USA, you are encouraged to notify Husarnet Company in accordance with Husarnet Company’s Digital Millennium Copyright Act (“DMCA”) Policy. Husarnet Company will respond to all such notices, including as required or appropriate by removing the infringing material or disabling all links to the infringing material. Husarnet Company will terminate a visitor’s access to and use of the Website if, under appropriate circumstances, the visitor is determined to be a repeat infringer of the copyrights or other intellectual property rights of Husarnet Company or others. In the case of such termination, Husarnet Company will have no obligation to provide a refund of any amounts previously paid to Husarnet Company.

Intellectual Property​

This Agreement does not transfer from Husarnet Company to you any Husarnet or third party intellectual property, and all right, title and interest in and to such property will remain (as between the parties) solely with Husarnet Company. ‘Husarnet’ name, Husarnet websites domains, the Husarnet logo, and all other trademarks, service marks, graphics and logos used in connection with Husarnet are trademarks or registered trademarks of Husarnet Company or Husarnet’s licensors. Other trademarks, service marks, graphics and logos used in connection with the Website may be the trademarks of other third parties. Your use of the Website grants you no right or license to reproduce or otherwise use any Husarnet Company or third-party trademarks.

Advertisements​

Husarnet Company reserves the right to display advertisements on your content.

Attribution​

Husarnet Company reserves the right to display attribution links such as ‘Powered by Husarnet’, theme author, and font attribution in your content footer or toolbar.

Changes​

Husarnet Company reserves the right, at its sole discretion, to modify or replace any part of this Agreement, Pricing Plan or licencing model of every Husarnet service (including app.husarnet.com and Husarnet client). If we revise this Agreement, Pricing Plan or license for Husarnet services, you may not be notified individually. Thus, we strongly advise you to periodically check this Agreement or Pricing Plan to review any changes. Your continued use of or access to the Website or Husarnet services following the posting of any changes to this Agreement or Pricing Plan constitutes acceptance of those changes. Husarnet Company may also, in the future, offer new services and/or features through the Website (including, the release of new tools and resources). Such new features and/or services shall be subject to the terms and conditions of this Agreement.

Termination​

Husarnet Company may terminate your access to all or any part of the Website at any time, with or without cause, with or without notice, effective immediately. If you wish to terminate this Agreement or your Husarnet account (if you have one), you may simply discontinue using the Website. All provisions of this Agreement which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Disclaimer of Warranties​

The Website is provided “as is”. Husarnet Company and its suppliers and licensors hereby disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose and non-infringement. Neither Husarnet Company nor its suppliers and licensors, makes any warranty that the Website will be error free or that access thereto will be continuous or uninterrupted. You understand that you download from, or otherwise obtain content or services through, the Website at your own discretion and risk.

Limitation of Liability​

  • In no event will Husarnet Company, or its suppliers or licensors, be liable with respect to any subject matter of this agreement under any contract, negligence, strict liability or other legal or equitable theory for: (i) any special, incidental or consequential damages; (ii) the cost of procurement for substitute products or services; (iii) for interruption of use or loss or corruption of data; or (iv) for any amounts that exceed the fees paid by you to Husarnet Company under this agreement during the twelve (12) month period prior to the cause of action. Husarnet Company shall have no liability for any failure or delay due to matters beyond their reasonable control. The foregoing shall not apply to the extent prohibited by applicable law.
  • Husarnet Company will not be liable for content and computer code created by third parties, including without limitation, content and computer code delivered by the Website.
  • You are solely responsible for the preservation of your data which you save on the Website. Husarnet Company shall have no liability for any data that may be lost, or unrecoverable, by reason of your failure to backup your data.

General Representation and Warranty​

You represent and warrant that (i) your use of the Website will be in strict accordance with the Husarnet Privacy Policy, Community Guidelines, with this Agreement and with all applicable laws and regulations (including without limitation any local laws or regulations in your country, state, city, or other governmental area, regarding online conduct and acceptable content, and including all applicable laws regarding the transmission of technical data exported from the country in which this website resides or the country in which you reside) and (ii) your use of the Website will not infringe or misappropriate the intellectual property rights of any third party.

Severability​

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

Indemnification​

You agree to indemnify and hold harmless Husarnet Company, its contractors, and its licensors, and their respective directors, officers, employees and agents from and against any and all claims and expenses, including attorneys’ fees, arising out of your use of the Website and Husarnet other Husarnet software (including Husarnet client) created by Husarnet Company, including but not limited to your violation of this Agreement.

Privacy policy

Personal data administrator​

Husarnet company is the administrator of your personal data collected in the course of using Husarnet website or any of its content.

Right of access​

You have the right to access your personal data collected by Husarnet Company at any time. You can make a subject access request verbally or in writing, using support@husarnet.com address. We will respond to your request without undue delay, but no later than within one calendar month.

Right of erasure​

You have the right to erase all your personal information from our systems. If you’d like to do so please send such a request to support@husarnet.com .

Right of data portability​

Right to restrict processing​

You have the right to request the restriction or suppression of your personal data. You can make that request verbally or in writing, using support@husarnet.com address. We will respond to your objection within one calendar month. When processing is restricted, Husarnet Company will be permitted to store your personal data, but not use it.

Right to object​

You have the right to object to the processing of your personal data when Husarnet Company doesn’t have a compelling reason for doing so. You can make an objection verbally or in writing using support@husarnet.com address. We will respond to your objection within one calendar month.

Automated decision making and profiling​

Husarnet Company does not use your personal data in the automated decision making process nor for the profiling of any kind.

What information do we collect?​

You have the right to be informed about the collection and use of your personal data. We collect information from you when you register on our site and gather data when you use Husarnet services.

When registering on our site, you may be asked to enter your name and e-mail address. You may, however, visit our site without registering. Your e-mail address will be verified by an email containing a unique link. If that link is visited, we know that you control the e-mail address.

When registered and using Husarnet services, we record the IP address that the request originated from. We also may retain server logs which include the IP address of every request to our server.

We may assist collecting information from third party programs running on the robots. If the information is stored on Husarnet servers, you can view it via the Cloud Platform.

If the third party stores information on their servers, you should consult their privacy policy.

What do we use your information for?​

Any of the information we collect from you may be used in one of the following ways: - To personalize your experience — your information helps us to better respond to your individual needs. - To improve our site — we continually strive to improve our site offerings based on the information and feedback we receive from you. - To improve customer service — your information helps us to more effectively respond to your customer service requests and support needs. - To send periodic emails — The email address you provide may be used to send you information, notifications that you request about changes to topics or in response to your user name, respond to inquiries, and/or other requests or questions.

Our site, products and services are all directed to people who are at least 13 years old or older. If this server is in the USA, and you are under the age of 13, per the requirements of COPPA (Children’s Online Privacy Protection Act), do not use this site.
